Mediation is a voluntary, non-binding, "without prejudice" process which involves the parties and their representatives sitting down with a mediator to discuss the issues in dispute and move towards reaching a settlement. The mediator has no power to make any decision or award but acts as a catalyst assisting the parties in negotiating a mutually acceptable solution.

Mediation is appropriate when direct negotiations have broken down, the parties are no longer talking to each other, either direct or through their Solicitors and Court is the only realistic alternative. Mediation keeps the outcome under the control of the parties and not dependent upon a third party decision from a Judge or arbitrator.
