Recent cases

A successful claim was brought against a Local Authority on behalf of an elderly woman who fell on a defective pathway, sustaining a serious injury to her foot. The Local Authority denied liability and the case went to a full trial. After hearing the evidence and after visiting the site (the Local Authority had stated that as they did not regard the defect as dangerous, they would not repair the area), the Judge found that the defect was dangerous, and the claim succeeded.

A claim was brought on behalf of an HGV driver who suffered very serious injury to his leg and hip when he was knocked from the tailgate of a vehicle by a ‘palletiser’ driven by another employee. Although liability was admitted, the value of the claim was fiercely disputed. The defendant made a low initial offer which the claimant rejected. The defendant then made an even lower offer which was also rejected. The claimant then took steps in preparation of trial before the claim eventually settled for a six figure sum - considerably more that the defendant had first offered.
